Frequently asked.
1What is the PMLA and when does it apply?
The Prevention of Money Laundering Act, 2002 applies to scheduled offences and deals with attachment of property, prosecution for money laundering, and obligations on reporting entities. It is enforced by the Enforcement Directorate (ED).
2Can the ED attach my property under PMLA without a court order?
The ED can provisionally attach property for up to 180 days under Section 5 PMLA pending adjudication by the Adjudicating Authority. We advise on challenging provisional attachments and appearing before the Adjudicating Authority.
3Do you represent both accused persons and complainants in financial crime matters?
We primarily advise on the defence side: advising persons who are the subject of ED inquiries, PMLA attachment, or prosecution.
